Action Alert!!!!


Part of the Governor’s latest budget proposal is a $90M loan from the OHV Trust Fund to help balance the state budget!


Although we understand that the state is in the grip of the worst budget crisis in history, this loan is not a solution to the problem!


Why? The law requires that this loan must be repaid within 2 years, so all this does is delay a real solution to the budget problem.


Similar tactics have been tried in the past. In recent years the state budget was often balanced by borrowing billions from constitutionally protected trust funds reserved for highway construction and repair of local streets and roads. Local governments united to oppose this borrowing gimmick and the governor and legislature agreed to stay away from borrowing from local government trust funds this year. Unfortunately this commitment does not extend to our OHV Trust Fund.


The governor is proposing an urgency bill that would authorize this loan. This money is our green sticker money that comes directly from the increased cost of green stickers from $25 to $50. This funding was supposed to go to law enforcement and other essential public safety services as well as improving the program. The public agreed to this fee increase to better fund the program, not to bail out the state budget.


What can you do?

It is urgent that OHV users get in touch with their state legislators as soon as possible.



Write or fax a letter to YOUR state senator and state assemblymember.


Tell them to stop borrowing to balance the budget.


Tell them the OHV Trust Fund should not be used to balance the budget


Loans like this are just gimmicks and not a solution to the real problem.


We were willing to raise our fees to be able to keep our program operating, we should not become the scapegoats in this budget battle.

During the last election many legislators signed a promise that they would not use borrowing to balance the budget.


Ask your legislators if they signed a "no borrowing pledge", and ask them if they are going to stand by that promise.


Specific points to make are:

1. Members of the public agreed to a fee increase to support a specific program, but now the revenue generated is being diverted from its intended purpose - a breach of public trust.

2. Borrowing from state funds that must be repaid does not solve the budget problem, it only defers dealing with the problem to a later date when it will be even more difficult to solve.

3. Using a trust fund as a revenue source sets a bad precedent. Trust funds are established up to protect public funds for specific purposes. This could lead to diversion of funds from other trust funds in the future potentially including even entitlement funds.

4. The budget crisis must be resolved through a combination of spending cuts and tax increases, not more borrowing.

I'm, not sure what bothers me more, the state taking a "loan" or the fact that there is 90 MILLION DOLLARS in the OHV fund not being used?! We can't have trash cans at Glamis, clean the roads up, create new riding areas or something?!!! This state is so far out of whack, we need to vote everyone of the worthless leaders out of office!!!! :x

OK, I called my reps Roy Ausburn and Connie Conway, Thier staff was
frindly and wrote down my request to not borrow 90 mil from
our off higway vehical trust fund

It only took about 2 minutes per call, very easy, we need to slam these guys
with calls

Why is the OHV community always to friggen pay?

Not falting other outdoor recreation , But dam it, We pay
for some of the opportunity to get these guys to
their hunting sites and fishing holes.

The final state budget approved by Gov. Arnold Schwarzenegger on Saturday did not include a controversial plan to borrow $30 million in wildlife funds from the Department of Fish and Game.

The proposed loan was controversial among sportsmen and wildlife advocates because it involved transferring $30 million generated by hunting and fishing license fees. That money is intended to be used for wildlife enhancement projects, not the state general fund. It also caught the attention of the U.S. Fish and Wildlife Service, which warned the state that it could lose another $30 million in federal matching funds if the loan took place.

State officials maintained that because the proposed revenue shift was a loan, and because it was predicted not to have any immediate impact on wildlife programs, it would not violate rules governing federal matching funds.

But in the final hour, said state Department of Finance spokesman H.D. Palmer, the $30 million shift simply didn't make the final menu of fiscal options in the budget.

"Just as the original mix of revenues that we had put forward weren't part of the package, so too was this not included," he said.

Wayne I hate to put CORVA on the spot with this but, I think an emergency Court action is in order to block the transfer, at least make them explain their logic as to how this wont adversely effect our program...TJ [-X

The fund loan will not affect the normal OHV grant program. This money that has been taken as a loan is money that is set aside for OHV land purchases and as there are no pending OHV land purchases this money is not required for the normal operation of the OHV program.

This is not to say anyone is happy about this loan but it does not affect the current operation of the SVRA’s or the pending grant applications.

We must be vigilant in seeing that this money is repaid and that we work with State Parks to utilize this money to purchase land for recreational opportunities.

Legal action on this issue is not warranted or cost effective at this time.

It's GOOD that it won't come out of the operations budget or pending grants :) Bad that they haven't used that money to buy more lands to give better oportunities to recreate :(

You are correct that we need to utilize the funds that have been set aside for land purchases.

To see the amount spent on operations and grants please note page 4 and 11 of the budget document below.

State Parks Budget

The 2009-2010 FY shows $54,940K for operations and $27,100K for Local assistance (Grants).

Note the loan of $90,000K in the 2008-2009 FY column.

Also note that the amount received from green sticker fees is estimated to be $17,374K for the 2009-2010 FY. The bulk of the money in this OHV fund does not come from green sticker fees but from gas taxes.

Anyone can access the state budget by doing a simple search on "California State Budget".
