Mostly I’m just passing through. Like Bill Jones, I’m a former BOD member of the ASA. Below is an edited version of my comments to Dave from the ASA BBS. Yes, I toned it down. Some of my snarkyness is related to the frustration I have constantly dealing with fixing mis-information and/or the mis-informed. I will say thank you all for your support of the ASA, they (we) are fighting hard to get back the areas closed to us.
I will, however, respectfully ask you to quit misquoting Mr. Jones. While I don’t know exactly what was said, I can be fairly sure that he DID NOT STATE A SPECIFIC DATE for reopening the dunes.
I’m sure he said ‘MAY’, MIGHT, PROBABLY, POSSIBLY’ or something similar. There is absolutely NO guarantee as to when the new RAMP will go into effect and Bill knows this very well and is smart enough to properly discuss it with others. I have not seen what is posted on the AMA site, but I would suggest that it be scrutinized carefully as well. It should also say “MAY, MIGHT, PROBABLY, POSSIBLY or something similar. And we need to clarify that releasing the RAMP does NOT mean that the dunes are immediately reopened. So, if anyone says ‘The RAMP will be out by 2012’, they MAY be correct, but…see below:
Reopening the dunes in 2012 is a POSSIBLITY only. The RAMP first must be released by the BLM. There is no required time table for them to do that. At the San Diego meeting, BLM advised that after the DRAMP comment period, which just ended this month, there would be an estimated 3 to 9 months before the final RAMP comes out but they could take longer. It will then go through a public review period and will, most probably, be challenged in court by the CBD, the ASA or, quite possibly, BOTH orgs. It has to survive all court challenges, which, in my experience (and I’ve actually been around for a while) each court challenge takes about 12 months. There is also a good possibility of an appeal by the loser, especially if that loser is the CBD. If it doesn’t survive the court challenges, (i.e, the CBD, the ASA or both win) it’s possible that we get to start this 4 to 5 year process all over AGAIN.
So, IMO, while 2012, is a POSSIBLIY, it is, also, IMO, rather OPTIMISTIC.
Note: I have no official line (or unofficial line) to anyone, but, if I were a betting man, look for the RAMP to be released some time late June to September 2011, with court challenges beginning January to March 2012. Even if the RAMP is released earlier, look for most of 2012 to be consumed with court challenges.
Some will call me a pessimist. I consider myself a realist. I hope I’m wrong and will gladly eat all the crow anyone cares to serve if things open up sooner.
